MPAC Data and Municipal Councils

Any employee, official or agent of a municipality that is engaged in a planning activity on behalf of the municipality may access and use MPAC information in respect of a planning activity.

The Information and Privacy Commissioner (IPC) ruled that except for unusual circumstances, for instance a councillor of a small municipality is appointed to oversee a specific project, members of a municipal council are generally not considered officers; nor, is a municipal councillor an employee or agent of the municipality.
